These terms and conditions incorporate the important requirements regarding the use of MyComputerRepair.co website and services and your relationship with computersupport.com. You must read them carefully as it contains important information and instructions related to terms of contract, its tenure, fee and /or penalties applicable to early termination, our right to change the conditions, limitation of liability, privacy, settlement of dispute by arbitration instead of normal action through the court if you accept this agreement. Your acceptance of the Terms & Condition will imply by the use of the MyComputerRepair.co services.
Software, Materials, Services provided by MyComputerRepair.co and other related information are collectively referred to as “Content.”
“You” means you individually, any person, including any employer that you are acting on behalf of.
“Plans” or “Subscription/(s)” are tenured Subscription plans offered by MyComputerRepair.co that are active for a specified period and will include any incident based plans.
“SERVICES” AND “MyComputerRepair.co PORTAL”
The term “Services” refer to any MyComputerRepair.co service delivered under the plan that you enter into with MyComputerRepair.co through the use of the MyComputerRepair.co or by calling the MyComputerRepair.co phone number mentioned on the MyComputerRepair.co website.
Subject to the Terms and Conditions, and other terms specific to each Plan, MyComputerRepair.co will address your query by applying commercially reasonable efforts in providing appropriate solutions under such Services. Under the regular process approach, MyComputerRepair.co will attempt to diagnose the problem and offer a solution thereby through chat, email or other means as it deems most appropriate under the circumstances including the utilization of remote access software tools and utilities. During such a remote access session on your computer there will be no residual software left from the remote session; however, there may be a text file placed on your computer that will explain the work that was done. If such a text file is placed on your computer, you have the option to either save the file for future reference or to delete it from your computer.
Services against any Plan Order will be available once you have made the payment for the Services according to the requirements of the corresponding Plan Order MyComputerRepair.co has no obligation to render Services under any Plan if the payments as required under the Plan ordered have not been made.
You may be charged an additional non-refundable Activation Fee at the time of registration, as specified in the Plan Order.
Similarly, some plans may offer a discount on the Service if there is a Discount available under any plan. You agree to maintain your Service and the bundled services for the applicable term. The discount under any plan is valid until one of the following occurs: (1) the term of such a plan expires; (2) you drop one of the MyComputerRepair.co service that you were required to purchase to receive the special rate as notified to MyComputerRepair.co ; or (3) You terminate the agreement/ plan before the expiry of the relevant term.
You may be asked to provide us with a card number from a card issuer that we accept in order to activate your Service. You hereby authorize MyComputerRepair.co to charge and/or place a hold on your card with respect to any unpaid charges for services.
You authorize MyComputerRepair.co and/or any other company who bills products or services, or acts as billing agent for MyComputerRepair.co to continue to attempt to charge and/or place holds with respect to all sums related to your plan/s or any portion thereof, to your card until such amounts are paid in full. You agree to proactively or upon request provide MyComputerRepair.co with updated card information upon MyComputerRepair.co when the information you previously provided is no longer valid.
You acknowledge and agree that neither MyComputerRepair.co nor any MyComputerRepair.co affiliated company will have any liability whatsoever for any non-sufficient funds or other charges incurred by you as a result of such attempts to charge, and/or place holds on, your card.
Payment made by credit card or debit card, payment will also be subject to the terms and conditions established by the credit or debit card issuer.
These tools may include software that enables us to remotely access and control a user’s computer with their permission. We require certain information and permissions from you to provide the Services.
Some information we collect may be provided directly by the user such as the ones provided in the request form or on the phone. However, other technical information might be accessed or collected during our diagnostic and related tools that we run while providing the Services.
TYPES OF INFORMATION
Personal information: These are identified as information that is required to personally identify you or in order for you to use our services and/or to contact you we require certain information that is personally identified by you.
Such information includes but is not limited to following – First and last name, E-mail address, Postal address, Personal identifier etc.
Payment information: Registering for a service requires us to collect credit/debit card information. MyComputerRepair.co may use third party payment processing, payment gateways transactions to process and verify credit cards on our behalf.
User’s computer information: We may also ask information related to your computer to update our support tools and enhance our supported products lists. Such information may include but not limited to data like the Date of purchase, Type of computer, Identification number, make and model of your computer, software installed or peripherals attached, system and registry data, error tracking files
Certain problem to may require enabling MyComputerRepair.co technicians to have access to and take control of your computer remotely over the internet without ever coming to the location of your computer.
MyComputerRepair.co does not use the Remote Access software to access and control your computer without your consent and we request that you remain present when our technicians are doing so.
MyComputerRepair.co technicians are trained in the use of this software and will take steps to limit access to confidential or sensitive information stored in your computer, avoid deliberate destruction of information on user computers or network.
MyComputerRepair.co uses some online diagnostic tools that may collect a wide variety of useful information about the state of a computer system and your applications. MyComputerRepair.co diagnostic application is not designed to collect sensitive information including information such websites visited, e-mail messages, e-mail addresses sent to, passwords, profiles, etc.
We use IP addresses to analyze trends, administer the website, track user movement, and gather broad demographic information for aggregate use.
We may share, disclose, or transfer your personal information as follows:
- To our affiliates and subsidiaries to support business operations and sales, marketing, and customer support processes;
- To third party service providers and suppliers acting on our behalf to provide products or services to you; and
- To other third parties for purposes you have allowed
Additionally, we may also disclose your personal information as we determine reasonably necessary to (a) comply with applicable law, regulations, legal processes, or enforceable governmental requests, (b) respond as necessary to actual or potential lawsuits, or (c) protect the rights and property of MyComputerRepair.co and our associate suppliers and third party.
We use a variety of security technologies to implement safeguards, to help protect personal information and other data we receive from unauthorized access, use, or disclosure. We cannot fully eliminate all security risks associated with personal information and technical mistakes are possible. No data transmissions, or even the physical transfer of information, can be guaranteed to be completely secure. Therefore, we do not ensure or warrant the security of any data or information you transmit to us and you do so at your own risk.
RENEWAL POLICY/UPGRADE POLICY
You agree and acknowledge that your Subscription under the Plan will automatically renew for the same period as mentioned in your Plan unless notified otherwise by you (“Auto-Renewal”).
However, a Plan shall be automatically renewed (in accordance with the terms of the Plan) only after we send you an email on the email id registered with MyComputerRepair.co 30 days before the expiry of your subscription term notifying you about the automatic renewal with an option to opt out from the automatic renewal and only if you do not opt out, your credit card, which was used in paying for the original plan or any other purchase from us will be charged with the amount of the then prevailing subscription charges as per the payment option that you selected at the time of registering with MyComputerRepair.co.
In some cases, MyComputerRepair.co may offer Upgrade Offers to you. Upon your acceptance of such Upgrade Offer, your credit card will be charged with the amount mentioned in the Upgrade Offer.
If you would like to opt out of the Auto Renewal, please call us at 1 (800) 828 6304 and speak with one of our customer service representative at least 30 days prior to your subscription end date to discontinue your service or write to us at XXXXXXXXX@XXXXX
In connection with obtaining Services, you agree that you will:
- Cooperate with the MyComputerRepair.co technician
- We will use commercially reasonable efforts to provide the support to you. Please listen to the technician carefully and follow the technician’s instructions.
You must confirm that the following:
- The situation is reproducible on a single system, i.e., one central processing unit with its workstations and other peripherals;
- You have the knowledge of facts and circumstances surrounding the incident and the hardware and any software involved
Software/Data Backup: You understand and agree that MyComputerRepair.co shall under no circumstance be responsible for any lost or corrupted software or data. MyComputerRepair.co strongly recommends to you to maintain at all times a complete data backup and disaster recovery plan.
- Account, Password, and Security: For you to submit a Plan Order, you must complete the Registration Process by providing us with current, complete and accurate information as required under the applicable Registration.
- You also will choose a password and a username to maintain an account with us. You are solely and entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are solely and entirely responsible for any and all activities that occur under your account. You agree to notify MyComputerRepair.co immediately of any unauthorized use of your account or any other breach of security. MyComputerRepair.co will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. You could be held liable for losses incurred by MyComputerRepair.co or another party due to someone else using your account or password. Likewise, you may not use anyone else’s account at any time, without the permission of the account holder.
AVAILABILITY OF SERVICES UNDER FORCE MAJEURE CIRCUMSTANCES
You hereby acknowledge that circumstances outside of MyComputerRepair.co’s reasonable control (such as acts of God, a large scale outbreak of a new computer virus, fires, floods, vandalism, sabotage, acts of third parties, or the like) may cause significant delays in MyComputerRepair.co’s ability to schedule a support session. You hereby release MyComputerRepair.co from any and all liability and agree that MyComputerRepair.co shall not be liable to you or any third party for any direct or indirect damages whatsoever, resulting from such delays.
MyComputerRepair.co or its suppliers may, at any time, without notice or liability, restrict the use of the Service or limit its time of availability in order to perform maintenance activities and to maintain session control.
EXCLUSION FROM “SERVICE”
- Diagnosis and support that may not be completed because of a problem with your computer or other equipment, or their configuration that is beyond our control
- Software, including the operating system and software, added to the registered hardware products which are out of scope for the Plan
- Problems likely to arise from
- External causes such as accident, abuse, misuse, or problems with electrical power;
- Usage that is not in accordance with product instructions
- Failure to follow the product instructions provided by manufacturer or failure to perform preventive maintenance
- Problems caused by using accessories, parts, or components not compatible with the product.
- Non Compliance with the MyComputerRepair.co technician instructions for resolving the query.
The Materials and Software are made available for download solely for use in accordance with the end user license agreement – EULA. Any reproduction or redistribution not in accordance to EULA is expressly prohibited by law and violators will be prosecuted to the maximum extent possible.
Without limiting to the para above, copying or reproducing any material or the software made available by MyComputerRepair.co or on its website to any other server or location for further use or reproduction, redistribution or any other purpose is expressly prohibited and may lead to cancellation of the service under any such plan. You may use the Software only as part of, or for use with, the Service in accordance with the Plan and for no other purpose.
With regard to any Software made available to you by MyComputerRepair.co for which your acceptance of a separate license agreement is not required, you are hereby granted a revocable, non-exclusive, non-transferable license by MyComputerRepair.co to use the Software and related corrections, updates and upgrades to it.
THIRD PARTY PRODUCTS
As part of the Services, MyComputerRepair.co may require you to install and use certain third party software or services. Third Party Software is licensed to you by their respective owners or licensees of the Third Party Software. You must agree to the terms and conditions set forth by such owners or licensees before installing Third Party Software, whether MyComputerRepair.co assists you in the acquisition, installation, and/or use of Third Party Software. MyComputerRepair.co has no responsibility or rights to the Third Party Software and does not license Third Party Software to you or make any representation or warranty regarding the Third Party Software.
Your use of any such services is subject to the terms of service of such third party service provider. You agree to comply with such provider’s terms of service and that the third party provider is solely responsible for delivery of its service(s) to you and your use of them.
Any such software which is owned by MyComputerRepair.co or its third party licensors, and suppliers, either of the aforementioned parties have the right to change or update the software from time to time.
The materials could include technical inaccuracies or typographical errors. Changes are periodically added to the information herein.
LIMITATION OF LIABILITY
Notwithstanding anything to the contrary in no event shall MyComputerRepair.co be liable to you in excess of the amounts actually paid by you to MyComputerRepair.co under the Plan Order that is the subject of the dispute.
MyComputerRepair.co reserves the right to amend the Terms and Condition, and the MyComputerRepair.co Portal at any time by (a) posting a revised version of the Terms and Conditions on the MyComputerRepair.co Portal
